1. Who runs this
Go 3D is operated by an individual in British Columbia, Canada. It is not a company. It is free, it carries no advertising, and it sells nothing. In these terms "we" means that person and "you" means anyone using the site.
2. Agreeing to these terms
You agree to these terms when you create or join an online game. If you do not agree, you can still use everything that runs entirely in your own browser: play the computer, work through the lessons, and read the site.
3. What we can and cannot see
Online games do not pass through a server we run. Your browser connects straight to the other player's browser, and moves and chat travel over that connection. We do not receive your messages, we do not store them, and we cannot read them, produce them, or delete them later. Nothing is logged because there is nothing in the path to do the logging.
The practical consequence is that we cannot moderate a game. If someone is unpleasant to you in chat, we have no ability to see it, no record of it, and no switch to remove it. Leave the game and start another. This is a limit of how the site is built, and you should know it before you rely on us to intervene.
4. Games are not private
A room code is the only thing protecting a game. Anyone who has the code can join and watch, and watchers can read the chat between the two players. If you list a game publicly, the code is visible to every visitor of the find page.
A direct connection also shows each player's IP address to the other, which is how a peer-to-peer connection is made at all. Treat an online game as a conversation with a stranger who can see roughly where you are connecting from. The privacy page sets this out in full.
5. Acceptable use
Do not use Go 3D to:
- harass, threaten, or abuse another player
- send anything unlawful, or anything you have no right to send
- impersonate another player by taking their display name
- occupy the public game slots to keep other people from using them
- work through room codes in bulk to reach games you were not given the code to
- attack the site, its lessons, or the connection between two players
We have no technical means to enforce this in a live game, for the reasons in section 3. It is here so the standard is stated, and so that conduct which breaks it is a breach of these terms rather than a matter of opinion.
6. Reporting something
If something on the site needs attention, write to sakaclothing.customerservice@gmail.com. We will act on reports of unlawful material, including reporting it to the police where the law requires. We cannot retrieve the contents of a game that has ended, so a report about chat will be a report about what you saw, not something we can confirm from our own records.
7. No warranty
The site is provided as it is, with no warranty of any kind. It may be unavailable, lose a game in progress, drop a connection, or stop working entirely. The computer opponent, the score estimate, and the lessons may all be wrong. Do not rely on this site for anything that matters.
8. Limits on liability
To the extent the law allows, we are not liable for indirect, incidental, special, or consequential loss, or for lost data, arising out of your use of the site. Our total liability to you for any claim connected with the site is limited to CAD $100.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under the law of British Columbia. These limits apply between you and us. They do not affect anyone else's rights, and they do not limit what another player may owe you.
9. Age
The site is not directed at children under 13. If you are under the age of majority where you live, read these terms with a parent or guardian before playing online with strangers.
10. Changes
These terms may change. The date at the top is the date of the current version, and the full history is public in the site's repository.
11. Governing law
These terms are governed by the law of British Columbia and the law of Canada that applies there. The courts of British Columbia have jurisdiction, though this does not take away any right you have to bring a claim where you live.
